SUBDIVISION ORDINANCE
The City of Benbrook Subdivision Ordinance regulates the Platting Process as well as infrastructure development within the City. It is the policy of the City of Benbrook that all subdivisions approved under this Ordinance must be consistent with the Comprehensive Plan, Zoning Regulations, Land Use Plan, and any other supplemental land use and community development policies that may be adopted by the City Council. No plat or subdivision of land within the City or its extraterritorial limits will be approved unless it conforms to such Plans, Policies, and Ordinances.

ZONING REGULATIONS
The City of Benbrook Zoning Regulations are the ordinances that regulate land uses and development requirements within the City. Requirements related to landscaping, parking, signage, exterior construction materials, lighting, land uses, building setbacks, and lot sizes are defined in the ordinances.

CHANGE OF ZONING
A change of zoning may be required if a property is not currently zoned properly for the owners intended use. The zoning districts and their permitted uses are specified in the Zoning Regulations. A Proposal to Amend Zoning Classification application must be submitted for Planning and Zoning Commission consideration and recommendation to the City Council to amend the Zoning District Map of the City of Benbrook.

VARIANCES AND APPEALS
A variance is a procedure where certain provisions of the Zoning Regulations can be relaxed when conditions peculiar to a specific property (and not the result of actions by the applicant) would cause an unnecessary and undue hardship with literal enforcement of the Zoning Regulations. A hardship occurs only when the literal application of the regulations would deprive the owner of all beneficial use of the property or render it virtually without value. Variances can be granted for standards such as setbacks, lot widths, lot depths, or building heights.
Appeals can be made of a decision made by a City Official when denying a building permit. An appeal can challenge the interpretation of the ordinance by the Building Official or the grounds by which the official made his/her decision, but an appeal cannot be made challenging the ordinance itself.

THE PLATTING PROCESS
Every owner of every tract of land located within the corporate limits or extraterritorial jurisdiction of the City of Benbrook who divides the tract into two or more parts, must have a plat made by a registered public surveyor that accurately describes all of the tracts by previously platted lot and block number, or by metes and bounds if necessary, and locate same as required by the Subdivision Ordinance.
